Terms and Conditions of the “Thousands of Reasons to Shop for Less” Promotion

§1 Definitions and General Information

1. These Terms and Conditions set forth the rules governing and the conditions for participation in the promotional campaign “Thousands of Reasons to Shop for Less,” consisting of granting Participants a discount through the use of the Discount Code CUTDEAL, valid from February 16 through March 23 (inclusive), subject to the provisions of these Terms and Conditions (hereinafter referred to as the “Promotion”).

2. The organizer of the Promotion is SHARG AG spółka z ograniczoną odpowiedzialnością, with its registered office in Warsaw at ul. Rożnowska 6, 04-213 Warsaw, entered in the National Court Register (KRS) under number 0000948950, Tax ID (NIP) 1133050109, REGON 521089940, BDO 000516251, share capital: PLN 2,420,000.00 (hereinafter referred to as the “Organizer”).

3. The Promotion is valid exclusively in the online store www.sharg.pl (hereinafter referred to as the “Store”) and applies solely to retail sales (B2C). The Promotion does not apply to wholesale transactions or B2B sales.

4. The Promotion is valid within the territory of the Republic of Poland.

5. These Terms and Conditions are continuously available on the Store’s website in a manner that enables their download, storage, and printing.

6. In matters not governed by these Terms and Conditions, the following shall apply:

• Generally applicable provisions of law.

7. Capitalized terms not defined herein shall have the meanings assigned to them in the Store Terms and Conditions.

8. For the purposes of these Terms and Conditions, the following definitions shall apply:

• Regular Price – the price of a Product displayed in the Store, not including any discounts;
• Reference Price – the lowest price of a Product within the 30 days preceding the discount;
• Terms and Conditions – this document;
• Store Terms and Conditions – the terms and conditions available at www.sharg.pl;
• Discount Code – a string of characters enabling a price reduction; within the scope of the Promotion, the code is CUTDEAL;
• Promotion – a limited-time offer introduced by the Organizer.

§2 Eligibility and Participation Conditions

1. A Participant in the Promotion may be a natural person who is at least 18 years of age, has full legal capacity, and enters into a sales agreement with the Organizer as a consumer.

2. The condition for taking advantage of the Promotion is:

• acceptance of these Terms and Conditions, or
• possession of an active Customer Account, or
• completion of a purchase as a guest by providing accurate and complete information.

3. Participation in the Promotion requires entering the Discount Code CUTDEAL in the shopping cart, which results in the automatic recalculation of the prices of Products covered by the Promotion.

§3 Promotion Rules, Discount Amount, and Exclusions

1. The Promotion applies to selected Products available on the dedicated Promotion subpage: https://sharg.pl/pol_m_Polecamy_Cut-a-deal-17998.html?discount_code=CUTDEAL and marked in the Store with an appropriate promotional label.

2. The Discount Code CUTDEAL activates the discount assigned to a given Product included in the Promotion.

3. The discount amount varies and is determined individually for each Product, and information regarding the value of the reduction is displayed directly on the product page and on the list of Products covered by the Promotion.

4. The discount is applied automatically upon entering the Discount Code CUTDEAL in the shopping cart, calculated from the Product’s Regular Price, unless otherwise indicated for a given Product.

5. Information regarding the amount of the discount constitutes an integral part of the commercial offer presented for the respective Product.

§4 Conditions for Using the Discount Code

1. The Discount Code CUTDEAL may not be combined with other promotions, discount codes, or reduced prices, unless the Organizer expressly provides otherwise.

2. Only one Discount Code may be used per Order.

3. The discount resulting from the Promotion does not apply to shipping costs or additional services.

§5 Withdrawal from the Agreement and Returns

1. In the event of withdrawal from a sales agreement for a Product purchased under the Promotion, the Participant shall be entitled to a refund of the amount actually paid, i.e., the price of the Product after application of the discount resulting from the use of the Discount Code.

2. In the case of partial withdrawal from the agreement (return of part of the Order), the discount shall be retained solely with respect to the Products kept by the Participant, provided that the conditions of the Promotion continue to be satisfied.

§6 Complaints

1. Complaints regarding the Promotion may be submitted in writing to the Organizer’s registered office address.

2. The Organizer shall review and respond to the complaint within 14 days from the date of its receipt.

§7 Personal Data

1. The Organizer is the controller of the personal data of Participants in the Promotion.

2. Personal data are processed for the purposes of administering the Promotion, fulfilling Orders, and handling complaints, in compliance with applicable laws and regulations.

§8 Final Provisions

1. The Organizer reserves the right to exclude any Participant who violates the provisions of these Terms and Conditions.

2. In matters not governed by these Terms and Conditions, the provisions of Polish law shall apply.

3. Amendments to these Terms and Conditions shall not infringe upon rights acquired by Participants in the Promotion.
