GENERAL TERMS AND CONDITIONS FOR DISCOUNT CODES

§1 Definitions and General Information
1. The organizer of promotional campaigns involving discount codes (hereinafter referred to as “Codes”) is SHARG AG sp. z o.o., with its registered office in Warsaw (04-213), ul. Rożnowska 6, entered into the National Court Register kept by the District Court for the capital city of Warsaw, 14th Commercial Division of the KRS, under number 0000948950, NIP: 1133050109, REGON: 521089940 (hereinafter: the “Organizer”).
2. Codes are valid exclusively in the Sharg.pl online store (hereinafter: the “Store”) and apply to retail (B2C) purchases. They do not apply to wholesale platforms or B2B transactions unless explicitly stated otherwise in the terms of the Code.
3. To use a Code, the Customer must accept these Terms and Conditions and either have an active customer account or place an order as a guest by providing valid contact information. The Organizer may require additional conditions to be met (e.g., having a newsletter account) as stated in the Code’s terms.
4. The duration, value, and scope of each Code are specified in communications relating to that Code (e.g., email, banner, promo page) and/or on the page: https://sharg.pl/client-rebate.php. Dates and times are given in local Polish time (CET/CEST).
5. For matters not covered herein, the general Store Terms and Conditions and applicable laws shall apply.
6. “Regular Price” – the product price currently displayed in the Store, excluding any reductions from Codes, promotions, loyalty programs, or individual discounts; serves as the basis for calculating the Code discount.
7. “Reference Price” – the lowest product price within the 30 days preceding a price reduction announcement, or, if the product has been available for less time – the lowest price since it was first listed; displayed in accordance with the Omnibus Directive.
§2 Types and Values of Codes
1. Codes may take the form of: (a) a percentage discount (e.g., –15%), (b) a fixed amount discount (e.g., –50 PLN), (c) a free shipping code, or (d) other forms as specified in the individual Code’s terms.
2. The exact value of the discount and any limitations (e.g., a maximum discount per order) are indicated with each Code on the page: https://sharg.pl/client-rebate.php.
3. Product scope: Unless otherwise specified, Codes do not apply to products in the “Sale/Hotshot” or “Promotion” categories, or items marked as “New.” Codes may apply to bestsellers unless otherwise stated in the specific Code terms.
§3 Conditions of Use
1. Single-use vs. multi-use: Whether a Code is for single or multiple use is specified in the Code’s terms. If not otherwise stated, the Code is single-use per customer.
2. Minimum order value: If a minimum cart value is required (calculated after other discounts and excluding shipping), the Code becomes valid only after reaching that threshold.
3. Combination with other promotions: Codes cannot be combined with other codes, coupons, promotions, loyalty programs, or discounted prices unless the promotion terms explicitly state otherwise.
4. Exclusions: Codes do not apply to discounted products, items in the “Sale/Hotshot” and “Promotion” categories, or “New”. Additionally, certain brands, categories, or products may be excluded; the current and binding list of exclusions is published at: https://sharg.pl/Restrictions-on-Discount-Code-Usage-Exclusion-List-cterms-eng-86.html. This list applies to all Codes unless explicitly stated otherwise and may be updated at any time; updates are effective from the moment of publication and do not affect orders placed before that date.
5. One person – one Code: It is prohibited to use Codes multiple times by the same person using multiple accounts or identities. If abuse is suspected, the Organizer may refuse Code redemption or cancel the order in accordance with the law.
6. Price scope: Unless otherwise stated, the discount applies only to product prices and does not cover shipping or additional services (e.g., gift wrapping), unless the Code refers specifically to free shipping. The discount is always calculated from the Regular Price; the Reference Price is informational only and not used to calculate the Code discount.
§4 Technical Guidelines
1. How to use: Enter the Code in the cart or during the checkout process in the “Discount Code” field, then confirm. The Code will be applied when the cart total visibly updates.
2. Accuracy: The Code will only work within its validity period and when all conditions are met. Typos, extra spaces, or special characters may prevent the Code from being applied.
3. Expired Codes: Codes that are no longer valid cannot be extended, reactivated, exchanged, or converted into cash.
§5 Returns, Cancellations, and Complaints
1. Full order return: If the Customer withdraws from the contract within the statutory period, they will receive a refund for the amount paid for the products and for the cost of the cheapest standard delivery, in accordance with the Store Terms. Used Codes will not be reissued or exchanged for cash.
2. Partial return: The Code discount is proportionally allocated to the returned and retained items based on their share of the order total. The refund reflects the actual amount paid after the discount.
3. Product complaints: Will be handled according to applicable laws and the Store Terms. Applying or not applying a Code does not affect warranty or statutory consumer rights.
§6 Amendments to the Terms and Promotions
1. The Organizer reserves the right to amend these Terms for valid reasons (e.g., changes in law, Store functionality updates, obvious errors, or security concerns). Changes do not affect customer rights acquired prior to their effective date.
2. The amended Terms come into force upon publication on the Sharg.pl website, unless another effective date is clearly specified.
§7 Rights and Restrictions
1. Ownership and resale prohibition: Codes are the property of the Organizer. Reselling, publishing on coupon sites without authorization, copying, or using Codes contrary to their intended purpose is strictly prohibited.
2. Right to refuse: In the event of a violation of these Terms, attempts to manipulate the discount system, or misuse of the Code, the Organizer may refuse to honor the Code or cancel the order — respecting consumer rights and issuing a full refund if applicable.
§8 Dispute Resolution
1. Parties shall first attempt to resolve any disputes amicably. If no resolution is reached, the dispute shall be settled by a court having jurisdiction over the Organizer’s registered office, subject to mandatory consumer protection laws.
2. These Terms do not limit any statutory consumer rights.
§9 Final Provisions
1. The current terms of individual Codes are available at: https://sharg.pl/client-rebate.php and in the promotional materials for the given campaign.
2. For matters not regulated herein, the general Store Terms and applicable laws apply.
